Cayman Islands: Ombudsman issues 2020 annual report
The Cayman Islands Ombudsman released, on 14 July 2021, its 2020 Annual Report. In particular, the annual report notes, among other things, that the largest area of case increases involved the Data Protection Act (2021 Revision) ('the Act') with 87 data breaches reported in 2020 and the number of data protection complaints doubling during 2020, compared to 2019. In addition, the annual report highlights the Ombudsman's first enforcement order under the Act, which required the Registrar of Companies to immediately cease gathering and processing personal data of non-registrable persons because there was no legal basis for its blanket approach. Moreover, the annual report outlines that the Ombudsman also issued a number of information orders directing both public and private sector entities to provide documents as part of data protection investigations, because the entities were not responding to requests in a timely manner. Finally, the annual report also addresses, among other things, matters like whistleblowing reports with six reported in 2020 as opposed to two in 2019.
