Brazil: Commission publishes updated report on AI bill
On July 4, 2024, the Temporary Commission for Artificial Intelligence in Brazil (the Commission) published its updated report analyzing amendments to Bill No. 2338/2023 on the use of artificial intelligence, complementing its previous report. The updated report focuses on analyzing the amendments to the bill proposed since its last report.
The amendments adopted by the Commission include:
- adding the protection of trade secrets as a principle under the bill;
- specifying that for an artificial intelligence (AI) system to be considered high risk, the possible damage resulting from the system has to be considerable;
- adding the automatic recording of operational processes as a governance measure to be adopted when using high-risk AI systems; and
- attributing to sectoral authorities the competence for the certification and accreditation of certification bodies.
