Baden-Württemberg: LfDI Baden-Württemberg publishes FAQs on Whistleblower Protection Act
On November 9, 2023, the Baden-Württemberg data protection authority (LfDI Baden-Württemberg) published frequently asked questions (FAQs) on the Whistleblower Protection Act (HinSchG). In particular, the LfDI Baden-Württemberg stated that the FAQs are intended to help answer data protection questions in relation to the HinSchG's coming into force on July 2, 2023. More specifically, the FAQs, among other things, answer queries regarding the obligations under the HinSchG, the legal basis for processing personal data and special categories of personal data by an internal reporting office, notification obligations under Article 14 of the General Data Protection Regulation (GDPR), the requirement for conducting a Data Protection Impact Assessment (DPIA) when setting up an internal reporting point, and data protection obligations in connection with the establishment of an internal reporting office.
