Austria: DGS amendment on Federal and National Council enters into effect

On July 17, 2024, the Parliament of Austria announced that the Federal Act amending the Information Regulation Act, the Data Protection Act, the Civil Service Act, and the Administrative Court Act entered into effect on July 15, 2024. 

The Parliament noted that the Law was adopted in response to a ruling by the Court of Justice of the European Union (CJEU) on the application of the General Data Protection Regulation (GDPR) by parliaments. Accordingly, the Law amends the Information Regulation Act as well as the Federal Act on the Protection of Individuals With Regard to the Processing of Personal Data (DGS). 

What are the notable amendments?

The Information Regulation Act was amended by the Law to include provisions regarding the processing of personal data by the National Council and Federal Council, including provisions on data subject rights. 

The DGS was amended, among other things, to establish the new Parliamentary Data Protection Committee as a national, independent supervisory authority for the National Council, the Federal Council, the Court of Auditors, and the Ombudsman (and the associated respective administrative matters).
