Andorra: APDA publishes data protection guide for real estate sector

On June 6, 2024, the Andorran data protection authority (APDA) published its consolidated guide titled 'Data protection guide for the real estate sector.'

The guide highlights data protection principles applicable to the real estate sector, namely the principles of lawfulness, loyalty, transparency, purpose limitation, data minimization, accuracy, limitation of retention period, integrity, and confidentiality. As well as this, the guide provides insights into what legal bases can be used when processing personal data in the real estate sector and includes examples of when such legal bases can be used.

Additionally, the guide explicitly states that organizations must maintain a record of processing activities and outlines what information must be included, and that even though companies or organizations of less than 50 workers do not have to maintain a record of processing activities, it is advisable to do so.

Lastly, the guide provides analyses of specific cases, including excessive processing of personal data by real estate agents, the need for a data protection delegate, and the installation of video surveillance cameras in rental properties.
