Shanghai: Municipal Government announces the release of a 'positive list' for cross-border data flows

On May 18, 2024, the Shanghai Municipal People's Government announced that the Management Committee of the Lingang New Area of ​​the Shanghai Free Trade Zone released a 'positive list' for cross-border data flows.

In particular, the Municipal Government highlighted that the list covers 11 scenarios such as intelligent connected vehicles, public funds, and biomedicine. The list is applicable to data processors registered in the Shanghai Free Trade Zone and Lingang New Area that conduct cross-border data flows.

Furthermore, the Municipal Government outlined that the director of the Data Department of the Lingang New Area Management Committee, Lu Sen, considers that "Not all data outside the list are negative lists. We will continue to dynamically update and expand iteratively to continuously clarify the safety boundaries."

Lastly, the Municipal Government clarified that the Lingang New Area also released a supporting guide for the list to help companies use the positive list and carry out cross-border data flows.
