Guatemala: Bill for Personal Data Protection Law passes Commission
On April 28, 2023, the President of the Transparency and Probity Commission issued their favorable opinion on Bill No. 6105 of June 23, 2022, for the Approval of the Personal Data Protection Law. In particular, the bill would:
- establish data protection principles, including the principles of transparency, fairness, and confidentiality;
- establish lawful bases for processing;
- define sensitive data as data that refers to the intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk to them;
- establish data subject rights; and
- enshrine obligations for data controllers and processors.
The bill will return to Congress where it will be further discussed.
