Mecklenburg-Vorpommern: LfDI Mecklenburg-Vorpommern publishes statement welcoming use of Corona Warning App for contact tracing
The State Commissioner for Data Protection and Freedom of Information Mecklenburg-Vorpommern ('LfDI Mecklenburg-Vorpommern') published, on 4 February 2022, a statement in which it welcomed the use of the Corona Warning App by companies for COVID-19 contact tracing. In particular, the LfDI Mecklenburg-Vorpommern noted that previously, companies were required to collect information from customers to forward the data to health authorities in helping to track infection incidents, making them responsible for collecting and storing such information in a secure manner.
In this regard, the LfDI Mecklenburg-Vorpommern stated that the new COVID-19 Ordinance now allows companies to fulfil their contact tracing obligations using the QR code created through the Corona Warning App. This, the LfDI Mecklenburg-Vorpommern noted, has the benefit of storing location data on the customer's own cell phone rather than with companies, eliminating the latter's responsibility over the personal information. Accordingly, the LfDI Mecklenburg-Vorpommern stated that this solution forms a win-win situation for all parties involved, since citizens regain sovereignty over their information and companies no longer face liability risks under data protection law.
