Pakistan: MOITT publishes revised draft of personal data protection bill
The Ministry of Information Technology ('MOITT') published, on 25 August 2021, a revised draft of the Personal Data Protection Bill for public consultation. In particular, the revised draft introduces new definitions for 'legitimate interest,' 'public interest,' and 'vital interest,' and explicitly provides for the establishment of the National Commission for Personal Data Protection.
The revised draft clarifies its scope of application, which now includes any controller or processor that is incorporated in any other jurisdiction, but otherwise digitally or non-digitally operational and involved in commercial or non-commercial activity within Pakistan. In addition, the revised draft provides enhanced obligations for controllers and processors, in addition to introducing new data subject rights such as the right to data portability and the right not to be subject to automated decision-making.
