Zimbabwe: MISA Zimbabwe publishes recommendations on data protection bill

The Media Institute of Southern Africa Zimbabwe ('MISA Zimbabwe') published, on 19 June 2020, its recommendations ('the Recommendations') on the cybersecurity and data protection bill ('the Bill'), following a discussion with members of the Parliament. In particular, MISA Zimbabwe suggested the separation of cybersecurity and data protection laws and published recommendations which were agreed upon as an action plan for working on the Bill. More specifically, the Recommendations include removing the Postal and Telecommunications Regulatory Authority of Zimbabwe ('POTRAZ') as the data protection authority and the cyber security centre, highlighting lawfulness, fairness, data accuracy, accountability and transparency as key principles for data protection and privacy, as well as defining notions such as 'consent', 'code of conduct', 'pseudonymisation' and 'anonymisation'. In addition, the Recommendations state that, following the signing into law by the President, the Bill should not immediately enter into effect, but, instead, allow an agreed timeframe to allow for compliance and reform before becoming fully operational.
