Yukon: IPC issues recommendations on HIPMA
The Yukon Information and Privacy Commissioner ('IPC') announced, on 2 September 2021, that it had issued 18 recommendations regarding the Health Information Privacy and Management Act 2016 ('HIPMA'), which is currently under review. In particular, the IPC highlighted that the social and technological context for the provision of healthcare has changed since the inception of HIPMA and that digital transformation has had a significant impact on individuals' privacy rights.
Therefore, the IPC recommended to strengthen its powers to enforce the HIPMA, to enhance security measures to better protect personal health information, and to implement stronger offence and penalty provisions in order to deter non-compliance. Lastly, the IPC made also a number of recommendations on the need to clarify the scope and application of HIPMA.
