Uruguay: URCDP announces changes to data transfer regime
The Uruguayan data protection authority ('URCDP') announced, on 16 September 2021, Resolution No. 23/021 of 8 June 2021, which establishes important changes in the international data transfer regime in Uruguay. In particular, the resolution replaces Resolution No. 4/019 of 12 March 2019 and excludes the United States of America from the appropriate territories, in addition to suggesting the use of other mechanisms, such as contractual clauses, consent of the interested parties, and other elements to justify transfers, giving a period of six months for the companies to make this justification to the URCDP. Moreover, the URCDP highlighted that to also collaborate with data controllers and processors, Resolution No. 41/021 of 8 September 2021 was published, which includes a guide for the drafting of contractual clauses.
