Tianjin: Office of the Cybersecurity and Informatization publishes a Negative List for the Pilot Free Trade Zone
On May 5, 2024, the Office of the Cybersecurity and Informatization of Tianjin (TJCAC) announced that the Administrative Committee of the Tianjin Pilot Free Trade Zone and the Tianjin Municipal Commerce Bureau released the 'Pilot Free Trade Zone Data Exit Management List (Negative List) (2024 Edition),' following the Regulations on Promoting and Regulating Cross-border Data Flows issued by the Cyberspace Administration of China (CAC).
The TJCAC outlines that the Negative List sets out the circumstances under which enterprises in the Tianjin Pilot Free Trade Zone that provide data overseas need to declare a data export security assessment, enter into a standard contract for the export of personal information, and pass personal information protection certification.
The TJCAC clarifies that there are 13 categories and 46 subcategories included in the Negative List, such as resources and environment, industry, and finance, detailing the basic characteristics of each category and facilitating the understanding and cooperation of enterprises.
Lastly, the TJCAC highlights that data other than those listed in the Negative List can flow freely across borders, thus making the Negative List system a more open management system.
