Shanghai: SMPG publishes administrative measures for Shanghai internet hospitals

The Shanghai Municipal People's Government ('SMPG') published, on 13 August 2019, administrative measures for Shanghai based internet hospitals ('the Measures'), which were originally written on 16 July 2019. In particular, the Measures stipulate that medical institutions and third-party organisations should clarify the rights and responsibilities of all parties in regards to medical services, information security, privacy protection, and medical risks through agreements and contracts. Furthermore, the Measures note that internet medical service information may not be stored in a server outside of China, and that the health administration should be promptly informed of any data breaches.

In addition, the Measures define registration requirements and how medical records should be administered. Moreover, the Measures also specify that its requirements will not apply to institutions who use IT to provide health care information services other than medical activities, such as registration appointments or health consultations.

The Measures shall come into force on 1 September 2019 and will be valid until 31 August 2024.
