New Mexico: Bill on the Government Use of AI Transparency Act passed by Judiciary Committee
On February 3, 2024, House Bill 184 on the Government Use of Artificial Intelligence Transparency Act was passed by the New Mexico House of Representatives Judiciary Committee. The bill was amended and passed by the Government, Elections & Indian Affairs Committee on January 29, 2024.
In particular, the bill would apply to executive cabinet departments and their administratively attached entities and employees with decision-making authority (agencies) and defines 'algorithm,' 'artificial intelligence,' 'artificial intelligence system,' 'assessment,' 'bias,' 'consequential decision,' 'use,' and 'transparency.'
Furthermore, the bill places the following requirements on the agencies:
- submit an inventory with information on the name, description, use, and assessments of the artificial intelligence (AI) systems to the department, as defined in the bill, on or before October 1, 2024, and each subsequent year;
- submit an inventory report to the governor on or before January 1, 2025, and on or before November 1 of each subsequent year;
- conduct assessments of the AI systems on or before July 1, 2025, and each subsequent year; and
- include a requirement for transparency in contracts for procurement with a vendor of an AI system.
