Montenegro: AZLP responds to initiative for dismissal of President of Agency Council

The Agency for Personal Data Protection and Free Access to Information ('AZLP') issued, on 10 December 2021, a press release in response to the initiative for the dismissal of the President and a member of the Agency Council, presented in the Parliament of Montenegro, on 9 December 2021, by the President of the Administrative Board and the President of the Committee on Human Rights and Freedoms. In particular, the AZLP outlined that the main reason for the dimissal initiative was alleged violations of Article 55(1)(4) of the Personal Data Protection Law 79/08 and 70/09 ('PDPL').

More specifically, the AZLP noted that no violation of the PDPL had occurred, and that the additional reasons for the dismissal presented were incorrect, untrue, and politically motivated. Additionally, the AZLP pointed out that the dismissal procedure presents several illegalities, such as the fact that no legal condition for dismissal of members of the Agency Council has been met. Moreover, the AZLP noted that the possible dismissal would lead to a total blockade of the AZLP and significant budget costs, both due to the inability to resolve cases within the legal deadline, highlighting that the failure to act of the Agency Council within the set time limit is a violation of the law.
