Mecklenburg-Vorpommern: Commissioner calls for state government to ensure data protection in operating systems and applications

The State Commissioner for Data Protection and Freedom of Information Mecklenburg-Vorpommern ('LfDI Mecklenburg-Vorpommern') released, on 17 March 2021, a statement together with the State Audit Office calling for the State Government of Mecklenburg-Vorpommern to ensure the protection of personal data in the context of its use of certain operating systems, office applications or video conference solutions, including Microsoft products, and the transfer of data to third countries. In particular, the LfDI Mecklenburg-Vorpommern highlighted that if the transmission cannot be prevented, or if it is necessary for the use of an application or a service, the state government must take suitable measures to ensure that an individual cannot be identified from the data (e.g. through anonymisation) or that the data transferred is encrypted. Furthermore, the LfDI Mecklenburg-Vorpommern noted that if the aforementioned is not possible, the processing must cease or an alternative product must be used that meets the requirements of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR').
