Mauritius: Office releases draft data protection guide for financial sector
On November 15, 2023, the Mauritius Data Protection Office (the Office) released its draft guide titled Data Protection in the Financial Sector. The guide aims to provide knowledge, best practices, insights on data protection for institutions in the financial sector, and guidance on the processing of personal data to ensure compliance with data protection principles as required under the Data Protection Act of Mauritius.
The draft guide looks at principles associated with data processing including duties of controllers, the collection of personal information, conditions for consent, and breach notification, among other things. More specifically, the draft guide examines topics to include:
- insights on governing legislation and regulations;
- details regarding the powers of the Office;
- personal data and special categories of personal data processed in the financial sector;
- requirements for the use of cloud computing for data transfers as well as the contractual obligations between financial institutions and cloud providers; and
- information regarding properly maintaining a lawful basis for the processing of personal data for direct marketing purposes.
The draft guide is expected to be launched for Data Protection Day in January 2024.
