Maryland: House Bill establishing Online Data Privacy Act referred to Committee on Economic Matters

On January 24, 2024, House Bill 0567, cross-filed with Senate Bill 0541, on an Act concerning the Maryland Online Data Privacy Act of 2024 passed its first reading and on the same date, was referred to the Committee on Economic Matters. If enacted, the bill would come into effect from October 1, 2024, and not have any effect on any personal data processing activities before April 1, 2025.

The bill aims to establish the manner in which a controller or processor may process a consumer's personal data, authorizing a consumer to exercise certain rights regarding their personal data and requires a controller to establish a method for a consumer to exercise certain rights regarding a consumer's personal data. The bill also provides that consumers may designate an authorized agent to opt out of the processing of personal data on their behalf.

The bill defines key terms such as 'controller,' 'processor,' 'identified or identifiable consumer,' 'unfair, abusive, or deceptive trade practices,' 'biometric data,' 'child,' 'consent,' 'dark pattern,' 'decisions that produce legal or similarly significant effects concerning the consumer,' 'personal information,' 'sale of personal data,' 'sensitive data,' and 'targeted advertising.'
