Mali: APDP issues statement criticising Cybercrime Law
The Malian data protection authority ('APDP') issued, on 27 April 2020, a statement ('the Statement') criticising the lack of data protection included in Law No. 2019-056 of 5 December 2019 on the Repression of Cybercrime ('the Cybercrime Law'). In particular, the APDP stated that the Cybercrime Law is generally considered to be a step forward to combat cybercrime but highlights that the Cybercrime Law does not take into account sanctions for privacy violations. Furthermore, the APDP explained that other countries such as Senegal frequently have a chapter or section in their respective cybersecurity laws that specify sanctions that are under the competence of the criminal judge.
