Macau: GPDP calls for compliance with China's PIPL in Macau
The Office for Personal Data Protection ('GPDP') released, on 15 September 2021, a statement in which it called for compliance with the Personal Information Protection Law of the People's Republic of China ('PIPL') in Macau. In particular, the GPDP highlighted that the PIPL has applicability outside of mainland China including where products or services are provided to natural persons in mainland China. Further to this, the GPDP noted that as Macau has strong economic and trade exchanges with mainland China, Macau institutions and individuals engaged in related mainland China affairs should pay close attention to the implementation of the PIPL. Finally, the GPDP maintained that the principled provisions of the PIPL and Macau's Personal Data Protection Act (Act 8/2005) ('PDPA') are similar; therefore, if the relevant institutions or individuals have always respected the PDPA, existing difficulties and legal risks should be minor.
