Jersey: JOIC issues blog post on transparency requirements under data protection law
The Jersey Office of the Information Commissioner ('JOIC') published, on 22 September 2022, a blog post addressing the transparency requirements under Article 12 of the Data Protection (Jersey) Law, 2018. In particular, the JOIC recalled that controllers are required to clearly explain to individuals what information is being collected and for what purpose, in a concise, intelligible, and easy-to-understand way, typically at the time of collection.
According to the JOIC, controllers may do so through a privacy policy or data protection statement which should include all the information set out in Article 12(4) of the Law. Furthermore, the JOIC also outlined a number of recommendations, including using certain words, providing accurate information about data retention, and keeping policies up to date.
