India: TRAI invites comments on unsolicited commercial communications consultation paper

On August 28, 2024, the Telecom Regulatory Authority of India (TRAI) announced that it issued the review of the Telecom Commercial Communications Customer Preference Regulations consultation paper seeking public comments. 

What is the aim of the paper?

The paper aims to strengthen the regulations, including stricter provisions against unregistered telemarketers. Broadly, the paper discusses, among other things:

  • definitions of commercial communications;
  • provisions related to the complaint redressal;
  • unsolicited commercial communications detecting system;
  • provisions related to financial disincentives;
  • provisions related to senders and telemarketers; and
  • analysis of a high number of voice calls and SMS.

Notably, the paper discussed the definition of consent. 

Public comments may be submitted via email at [email protected] by September 25, 2024. Counter comments, if any, may be submitted by October 9, 2024.
