California: CPPA publishes materials ahead of October Board Meeting

On October 1, 2024, the California Privacy Protection Agency (CPPA) published additional materials ahead of its board meeting scheduled for October 4, 2024. The CPPA published, among other documents, the draft text for the Data Broker Registration Regulations.

Draft Data Broker Registration Regulations

The Initial Statement of Reasons outlined that the Draft Regulations will:

  • clarify and establish specific rules relating to the registration fee, including price and payment methods, and that the fees will not be prorated or refunded;
  • define the terms:
    • 'direct relationship' to clarify which businesses are data brokers;
    • 'minor' as persons under 16 years of age and to establish when a business is considered to have knowledge of a person's age;
    • 'register' to provide clarity on the requirements for completion of registration;
    • 'registration period' to provide clarity on the start date for data broker registration; and
    • 'reproductive health care data' and provide examples;
  • emphasize that each data broker business, regardless of status as a subsidiary or parent company, is required to uniquely register; and
  • outline requirements for registration, updates to the registry, and website disclosures.
